Terms of service

1. Agreement

These terms form a contract between you and Ladakh Goods LLC, 1123 N Orange St, Suite 204, Wilmington, DE 19801 ("Ladakh", "we"), covering your use of ladakhtouroperators.com and any purchase. By browsing or ordering you accept them. If you don't, don't use the site.

2. Eligibility

You must be at least 18 and able to form a binding contract. We don't verify age at checkout; the obligation is on you. Orders to a minor's name are still valid if placed by an adult.

3. Products and descriptions

We describe products as accurately as we can, including dimensions, materials, noise, and waterproof rating. Colors vary slightly between screens. Specs are measured values with normal tolerance, not guarantees of a sensation — how a product feels is subjective.

Products are adult novelty items, not medical devices, unless a page says otherwise. Nothing on the site is medical advice, diagnosis, or treatment. Statements like "many people find" are reports of experience, not clinical findings.

4. Orders and acceptance

An order is an offer. It's accepted when we send the shipping confirmation. Until then we can decline, for example if the item is out of stock after a simultaneous sale or the price was listed in error.

We can cancel and refund in full if we suspect fraud, freight-forwarding abuse, or resale-scale quantities on a retail order.

5. Prices, tax, and errors

Prices are in US dollars and exclude sales tax, which is calculated at checkout by destination. Prices can change without notice; the price at the moment you order applies to that order.

Obvious pricing errors (for example a $79 item listed at $7.90) can be cancelled and refunded even after a confirmation, at our discretion, with notice.

6. Payment

We accept Visa, Mastercard, American Express, Discover, Apple Pay, and Shop Pay. Card authorization happens at checkout; capture happens at dispatch. If an authorization fails or a charge is reversed, we may hold the order.

Your statement descriptor is LGH LLC. If you file a chargeback, we may ask for information to contest it and the order stays on hold until resolved.

7. Shipping and risk of loss

Shipping terms are in the shipping & returns policy, which forms part of these terms. Title and risk of loss pass to you on delivery to the carrier, but we handle carrier claims for lost and damaged parcels as described there.

8. Returns

30 days, unopened or faulty, per the returns policy. Because these are intimate goods, opened items are returnable only where faulty or where the seal is intact. Refunds go to the original payment method; we don't issue store credit unless you ask.

9. Warranty

Products carry a 1-year mechanical warranty (2 years for Cove). It covers manufacturing faults, not water damage beyond the stated IP rating, drops, or normal wear. This is a limited warranty; it doesn't extend your return window and isn't a service contract.

Warranty claims need an order number. Remedies are repair, replacement, or refund of the item — our choice.

10. Your obligations

• Give accurate name, address, and email; confirm the address before dispatch.
• Use products as described, including water-based lubricant only with silicone.
• Clean products per the care instructions and inspect before first use.
• Don't resell as new, scrape the site, or probe it for vulnerabilities without telling us.
• Don't use the site unlawfully or interfere with other users.

11. Account and cart data

There's no account system; the cart lives in your browser's local storage. Clearing site data clears the cart. We aren't responsible for a cart lost that way, or for a cart in a private window that closes.

12. Intellectual property

The Ladakh name, logo, product names, copy, and the site's SVG illustrations belong to us. You may use product images and short quotes for editorial or review purposes with attribution. Scraping for a competing store is fine; wholesale copying of the entire catalog text is not.

13. User content

If you send a review or photo, you grant us a non-exclusive, worldwide, royalty-free license to use it on the site and in marketing, with your first name and city as shown. You confirm it's yours. We can edit for length but won't change your meaning, and we can decline to publish. We don't remove three-star reviews.

14. Third-party links

Links out (payment providers, carriers) are for convenience. We don't control those sites and aren't responsible for their content or terms.

15. Disclaimers

To the fullest extent permitted by law, the site is provided "as is." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where they can't be disclaimed. We don't warrant uninterrupted or error-free operation of the site.

Nothing here limits the statutory rights of a consumer in their state of residence.

16. Limitation of liability

To the extent permitted by law, Ladakh isn't liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability on any order is limited to the amount you paid for the products in that order, plus shipping.

The limit doesn't apply to death or personal injury caused by our negligence, fraud, or anything else that can't be limited.

17. Indemnity

You'll indemnify us against third-party claims arising from your breach of these terms or misuse of a product, to the extent the claim is your fault.

18. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. For matters that go to court, the state and federal courts sitting in New Castle County, Delaware have exclusive jurisdiction. Governing law and venue to confirm with counsel

19. Arbitration and class action waiver

Please read. Except for small claims and injunctive relief, any dispute arising from these terms or a purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration happens in New Castle County, Delaware, or by written submission if both sides agree. The arbitrator can award the same relief a court could.

You and we each waive the right to a jury trial and the right to participate in a class action or class arbitration. If the class waiver is unenforceable, the rest of this section survives.

Opt-out: email hello@ladakhtouroperators.com with "Arbitration opt-out" in the subject within 30 days of your first order. Opting out doesn't affect anything else.

Either side may bring a qualifying claim in small claims court instead, and either may seek injunctive relief in court to protect intellectual property.

20. Termination

We can suspend or block access for breach. Sections on liability, indemnity, and dispute resolution survive.

21. Changes

We can amend these terms. Material changes get a site notice for 30 days. The version in force when you ordered governs that order.

22. General

If a provision is unenforceable, it's severed and the rest stands. Our failure to enforce something isn't a waiver. These terms plus the shipping, privacy, and cookie policies are the whole agreement.
